Cleveland Krist Wins High-Stakes Commercial Arbitration for Investment Fund and Founder

On December 16, 2024, following a final evidentiary trial, an arbitrator in Houston, Texas ruled in favor of the Firm’s clients, a prominent investment fund and its founder, in a dispute with a third party regarding control of the fund, which manages over $300 million of investor capital. The matter involved claims for fraud and breach of fiduciary duty, and the Firm’s clients were victorious in the arbitration which allows them to maintain full control and ownership of the fund.

“This was a massive victory for our clients to maintain control of the fund that they founded in the face of a series of attempts to wrest that control from them,” said Tim Cleveland. “Our clients were steadfast in the face of counterclaims and other baseless accusations made by their adversary, and we are thankful that our clients were vindicated following the trial of this matter.”
